Kylie Jenner's Kylie Cosmetics has been in the midst of a logo controversy since June, but now makeup artist Vlada Haggerty is moving ahead with a copyright infringement lawsuit over the images being used on the brand's packaging and in the ad campaign.
The Los Angeles-based makeup artist claims Jenner is "misappropriating" her imagery, in connection with Kylie Cosmetics.
TMZ reports that although many of the images Kylie Cosmetics uses in its ads and on its packaging are extremely similar, they are different photos, and "ideas are not protected by copyright law."
The Fashion Law has a different take on the issue, saying that Haggerty cannot claim infringement based on the copying of her ideas, but she may have a claim based on the copyright notion of derivative works.
